A governança global com e sem Governo: o protagonismo das empresas transnacionais na internacionalização do direito
Resumo
RESUMO
O presente artigo tem por objetivo abordar a reestruturação do cenário político internacional contemporâneo, investigando como ocorreu o afastamento da governança do núcleo teórico do governo e averiguando a influência das empresas transnacionais nas tomadas de decisão da sociedade globalizada. Inicialmente, identifica-se que a governança pode ser exercida alheia à vontade estatal, estando presente tanto em entes racionais-burocráticos como o Estado, quanto em atores líquidos e voláteis como os grupos terroristas. Esse novo panorama faz torna possível a categorização de “governança com governo” e “governança sem governo”. Por fim, revela-se que os novos atores, especialmente as empresas transnacionais, desempenham funções proeminentes no cenário político da sociedade internacional, inclusive na internacionalização do direito, porquanto a crise do Estado-nação tem causado uma proliferação de normas privadas, evidenciando-se que a jurisdição estatal deixou de deter exclusividade na interpretação e aplicação do direito. Pelo menos no âmbito jurídico, a sociedade contemporânea tem se caracterizado por reeditar as principais características do feudalismo.

GLOBAL GOVERNANCE WITH AND WITHOUT GOVERNMENT: THE LEADERSHIP OF TRANSNATIONAL CORPORATIONS IN LAW INTERNATIONALIZATION
ABSTRACT
This article intends to address the restructuring of contemporary international political scene, investigating how was the removal of the governance of the theoretical core of the government and ascertaining the influence of transnational corporations in the global society decision making. Initially, it was identified that governance can be exercised unrelated to State will, being present in both rational-bureaucratic entities such as the State, as in liquid and volatile actors like terrorists. This new panorama turns possible the categorization of "governance with government" and "governance without government". Finally, it is revealed that the new actors, especially transnational corporations, perform prominent functions in the political arena of international society, including the internationalization of law as the nation-state crisis has caused a proliferation of private standards, showing that the state no longer has exclusive jurisdiction in the interpretation and application of the law. At least in law area the contemporary society is defined by reissuing feudalism main aspects.
