O Direito e a Pós-Verdade: a eclosão das “fake news” no processo democrático à luz da ordem constitucional brasileira, Law and Post-Truth: the emergence of “fake news” in the democratic process from the perspective of the Brazilian constitutional order
Resumo
A volatilidade inerente ao alcance dos meios de comunicação, o imediatismo da notícia no século XXI e a grande produção de “fake news” na era da (des)informação acarreta a violação de inúmeros direitos fundamentais. Nesse cenário da Pós Verdade, o contexto sociopolítico sofre com o enfraquecimento de suas instituições e com a mitigação das disposições do texto constitucional, no entanto, o combate às notícias falsas reafirma o compromisso com a democracia. O método de investigação científica aplicado será o indutivo, a metodologia de pesquisa adotada a qualitativa, com caráter eminentemente exploratório. Observa-se os meios combativos à era da Pós Verdade, bem como, à propagação de “fake news”, através do estudo analítico sistêmico de teorias constitucionais, buscando a prevenção e punição efetiva daqueles que infringem à lei, assegurando assim, a ordem constitucional brasileira.
The volatility inherent in the reach of the media, the immediacy of news in the 21st century and the great production of “fake news” in the age of (un) information leads to the violation of numerous fundamental rights. In this Post-Truth scenario, the socio-political context suffers from the weakening of its institutions and the mitigation of the provisions of the constitutional text, however, the fight against false news reaffirms the commitment to democracy. The method of scientific investigation applied will be inductive, the research methodology adopted is qualitative, with an eminently exploratory character. The combative means of the Post-Truth era can be observed, as well as the spread of “fake news”, through the systemic analytical study of constitutional theories, seeking the prevention and effective punishment of those who break the law, thus ensuring the constitutional order Brazilian
