Resumo
Com o resultado da Arguição de Descumprimento de Preceito Fundamental (ADPF) 153, que indeferiu o pedido de nulidade do parágrafo 1º do art. 1º da Lei de Anistia, torna-se extremamente difícil a identificação e punição dos responsáveis pelas práticas de tortura que permearam o período da ditadura no Brasil, prejudicando também a efetivação direito à memória nacional. Assim, esse artigo procura investigar outros foros, internos ou internacionais, que seriam competentes para o julgamento destes indivíduos. A possibilidade da arguição de uma competência universal será consequentemente abordada para que se avalie sua adequação ao julgamento dos crimes contra a humanidade.
Abstract
With the outcome of the claim of breach of fundamental precept (ADPF) 153, rejecting the application for revocation of paragraph 1 of Art. 1 of the Amnesty Law, it becomes extremely difficult to identify and punish those responsible for torture practices that permeated the period of dictatorship in Brazil and to effective the right of a national memory. Thus, this article seeks to investigate other forums, domestic or international, that would be competent for the prosecution of these individuals. The possibility of a complaint of universal jurisdiction will therefore be addressed to evaluate its suitability for the prosecution of crimes against humanity.
