DA NECESSIDADE DA PROCESSUALIZAÇÃO DO INQUÉRITO POLICIAL PARA A EXISTÊNCIA DE UM PROCESSO PENAL VERDADEIRAMENTE ACUSATÓRIO (THE NEED FOR POLICE PROCESSUALIZAÇÃO SURVEY FOR THE EXISTENCE OF A CRIMINAL CASE LIBELOUS TRULY)
Resumo
A maioria da doutrina e estudiosos do processo penal insistem em afirmar que o inquérito policial é mera peça de informação destinada a formar a opinião do titular da ação penal acerca da infração criminal e sua respectiva autoria. Contudo, no plano concreto, a ausência de exclusão física dos autos do inquérito policial do processo, faz com que pessoas sejam condenadas com base na “prova” inquisitorial. A par disso e dos ditames do Processo Penal Democrático, se faz necessário identificar que o indiciado é um acusado em sentido amplo e que o inquérito policial não pode ser analisado como mero procedimento administrativo, mas como processo administrativo que deve garantir sua ampla participação no respectivo ato preparatório do provimento final.

Most of doctrine and scholars of criminal insist that the police investigation is mere piece of information for forming the opinion holder's prosecution on the criminal offense and its respective authors. However, at the concrete level, the absence of physical exclusion from the file of the police investigation process, causes people to be convicted based on "proof" inquisitorial. Alongside this and the dictates of Criminal Procedure Democratic, it is necessary to identify the accused is an accused in a broad sense and that the police investigation can not be considered as a mere administrative procedure, but as the administrative process that should ensure wide participation in its preparation of the final act.
