Eficácia dos direitos fundamentais nas relações entre particulares: critérios para ponderação de interesses
Resumo
Este artigo analisa critérios para a ponderação de interesses em casos de conflitos entre direitos fundamentais no âmbito das relações privadas. A partir da análise de pressupostos essenciais à compreensão do tema, tais como a evolução do constitucionalismo liberal ao constitucionalismo social, a concepção de força normativa da Constituição e a superação da dicotomia ente direito público e privado, procura-se assentar a ideia de que os direitos fundamentais têm aplicação nas relações entre particulares, bem como apresentam-se as principais teorias sobre a eficácia dos direitos fundamentais nas relações privadas. Realiza-se uma análise crítica dos critérios de ponderação de interesses propostos pela doutrina nacional. O objetivo é sistematizar os critérios que devem orientar a ponderação, a fim de se incremente a objetividade e racionalidade no exercício da mesma, o que contribuirá para a efetividade dos direitos fundamentais.

EFFECTIVENESS OF FUNDAMENTAL RIGHTS IN PRIVATE RELATIONS: CRITERIA FOR WEIGHING OF INTERESTS
ABSTRACT
This article analyses criteria for the weighing of interests in cases of conflict between fundamental rights in private relations. From the analysis of key assumptions, such as the evolution of liberal constitutionalism to social constitutionalism, normative force of the Constitution and the overcoming of public and private law dichotomy, seeks to enforce the idea that fundamental rights have application in relations between individuals, and presents the main theories on the effectiveness of fundamental rights in private affairs. It perform a critical analysis of the weighing criteria proposed by national doctrine. The goal is to systematize the criteria that should guide the weighing process, in order to increment the objectivity and rationality, thus contributing to the effectiveness of fundamental rights.
